Terms of Service

1.Acceptance of these terms

By accessing or using the Service, operated by Zhang Wei ("we", "us", "our"), you agree to these Terms of Service. If you do not agree to them, do not use the Service.

2.The Service

Proofika is a browser-based editor that renders testimonial and social-proof cards ("Cards") from content you provide, and exports them as PNG, GIF or SVG images. Editing happens in your browser, and so does most export; SVG export, and PNG export in some cases, is rendered on our servers instead. Section 4 of our Privacy Policy says what happens to your content when that happens. The Service is offered in a free tier and a paid "Pro" tier.

3.Eligibility

You must be at least 16 years old and able to form a binding contract. If you use the Service on behalf of a company or other organisation, you confirm that you are authorised to bind it to these terms.

4.Your account

• Most of the Service can be used without registering. Guest use is subject to the fair-use limits described in section 10.
• If you create an account — either by signing in with Google or by registering an email address and password — you are responsible for everything that happens under it and for keeping your credentials confidential.
• Give us accurate information, and tell us promptly at proofika@163.com if you believe your account is being used without your permission.

5.Your content and your responsibilities

• "User Content" means the review text, names, handles, ratings, photographs, logos and any other material you put into the Service.
• You keep ownership of your User Content. You give us a limited, non-exclusive licence to process it only so far as needed to run the Service: rendering a Card, keeping a project you asked us to save, and producing the export you asked for.
• You represent and warrant that: (a) you hold every right and consent needed to use and publish the User Content, including any personal data or copyrighted material inside it; (b) it is accurate and not misleading; (c) any review or endorsement shown in a Card is either a genuine statement made by the person it is attributed to, or is used with that person's permission.
• You are solely responsible for your User Content and for the laws that apply to how you use it, including advertising and endorsement rules such as the FTC Endorsement Guides in the United States and equivalent consumer-protection rules elsewhere.

6.Prohibited uses

You may not:

• create Cards that fabricate a testimonial, review, endorsement, rating or metric that does not exist or was never given;
• impersonate any person or organisation, or misstate your relationship to one;
• use a Card to deceive consumers, to break the rules of a platform you publish it on, or to break any law;
• upload material that is unlawful, defamatory, infringing or otherwise harmful;
• remove or obscure the free-tier watermark, or get around quotas, rate limits or other technical limits, including by automated means;
• resell, rent or sublicense the Service, or run it as a service bureau;
• reverse-engineer, scrape or probe the Service beyond ordinary use of it.

We may suspend or terminate access for a breach of this section, without refund.

7.Our intellectual property; the watermark

The Service itself — its templates, code, design and branding — belongs to us and is licensed to you, not sold. Cards you export are yours to use, subject to sections 5 and 6. On the free tier, exported Cards carry a small Proofika watermark; removing or hiding it without a Pro licence breaches these terms. Pro removes the watermark.

8.Third-party platform interfaces

Cards are designed to resemble the interfaces of third-party platforms (such as X, LinkedIn, Reddit, G2 and Amazon) so that an exported image reads as a screenshot of a real review. Proofika is not affiliated with, endorsed by, or licensed by any of those platforms, and their names, logos and trademarks remain the property of their owners. You are responsible for using a Card in a way that does not imply an endorsement, affiliation or verification that does not exist, and for complying with the rules of whichever platform you publish it on.

9.Pro subscriptions, payments and refunds

• Pro is a subscription, not a one-off purchase. It costs US$10 per month and is billed monthly — there is no annual plan.
• It renews automatically at the end of each month until you cancel. We charge the subscription on the same day of each month, and the current renewal date is shown in your account menu.
• You can cancel at any time, in one click, from your account menu — no email, no phone call, no "contact support to cancel". Cancelling stops future charges; your Pro access continues until the end of the period you have already paid for, after which the account falls back to the free tier and exports carry the watermark again.
• If a renewal payment fails, we will tell you by email. Pro continues until the end of the current period; if the payment is not settled by then, the subscription ends and the account falls back to the free tier.
• Payments are taken by Waffo Pancake, which acts as the merchant of record: Waffo Pancake, not us, is the seller of your subscription, and it handles invoicing, sales tax and VAT, and payment disputes under its own terms. We never receive your card details.
• Refunds. We do not refund part of a month: cancelling leaves your access intact for the rest of the period you paid for, which is the fairer outcome. Where a statutory right of withdrawal applies to your first payment, we honour it. For anything else, write to proofika@163.com and we will put the request to Waffo Pancake; refunds are considered case by case and are subject to Waffo Pancake's terms as merchant of record.
• Prices may change for future periods. We will tell you before a change takes effect, and cancelling remains available at any time before it does.

10.Free tier, quotas and fair use

The free and guest tiers are subject to limits — for example, a quota on imported review URLs for signed-in accounts, caps on export sizes and formats, and rate limits on server-side rendering. Guest limits are enforced with short-lived counters. We may adjust the limits, and will say so in the Service when we do.

11.Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". WE DO NOT WARRANT THAT A CARD WILL MATCH ANY THIRD-PARTY INTERFACE EXACTLY, OR THAT A THIRD-PARTY PLATFORM WILL NOT CHANGE THE WAY ITS OWN INTERFACE LOOKS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

12.Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR (b) US$100. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, OR FOR CLAIMS THAT ARISE FROM YOUR USER CONTENT OR FROM THE WAY YOU USE A CARD, INCLUDING CLAIMS BROUGHT AGAINST YOU BY SOMEONE ELSE.

13.Indemnity

You will defend and indemnify us against claims, damages and expenses arising from your User Content, your use of a Card, or your breach of these terms.

14.Termination

We may suspend or terminate your access for a breach of these terms or for abuse. You may stop using the Service at any time and may ask us to delete your account. The clauses that by their nature should survive — ownership, disclaimers, limitation of liability and indemnity — survive termination.

Discontinuing the Service. We may change or discontinue Proofika, in whole or in part. Where we decide to close it, we will announce it at least 30 days beforehand, we will stop accepting new subscriptions at the same time, and we will cancel all renewals so that no further payment is taken — you keep Pro until the end of the period you have already paid for. We will tell you how to export anything stored in your account before it is deleted. If a closure leaves a paid-for period unserved, we refund that period; nothing else is owed.

15.Changes to these terms

We may update these terms. If a change is material we will say so in the Service or by email where that is practical. Continuing to use the Service after the effective date means you accept the updated terms.

16.Governing law

These terms are governed by the laws of the People's Republic of China, excluding its conflict-of-law rules. Your purchase of Pro is contracted with Waffo Pancake under its own terms as merchant of record, which may specify a different governing law for the transaction itself.
